First Personal Injury Warns About Construction Site Accidents

Construction accident claims solicitors First Personal Injury say that despite figures published by the Health and Safety Executive (HSE) showing a significant reduction in the number of people killed, injured or suffering work related illnesses from April 2008 to March 2009, statistics are still showing that accidents on construction sites have the highest rates of fatal injuries.
First Personal Injury Partner, Michael Jefferies comments: “Over the past year there were 53 deaths following accidents on construction sites and HSE statistics show that reported construction site injuries were mainly caused by falls from heights, falling objects, contact with moving machinery, collapses/overturns and electrocution. Construction companies must ensure that they are aware of all the main issues regarding risk assessment and be should be reminded that, following amendments to the Health & Safety Offences Act 2008, it is obligatory to comply with health and safety regulations. Risk assessment in the workplace, understanding current legislation, obtaining the necessary equipment from a huge range of personal protective equipment (PPE) available and then providing adequate training as well can be a daunting task for an employer. However, it is the legal responsibility of an employer to provide a safe working environment and right equipment.”
Working at height on a roof or on scaffolding is still the biggest single cause of serious and fatal injuries, according to the HSE. According to their report, the Executive inspected 1759 sites and 2145 contractors in March 2009. Of those sites inspected, 265 Prohibition Notices were issued on work at height. This demonstrates that there are still some contractors who are still not taking the dangers seriously. In 11 of the 1,759 sites inspected, conditions were considered to be so poor that prosecution is now being considered. The HSE also found that one in six sites were failing to address work at height risks, leaving workers vulnerable to serious injury or even death in the event of a fall.
Although preventable, construction accidents change the lives of the injured and their families and it is important that when a construction accident occurs, the injured party receives the correct compensation.

BMC Software and salesforce.com, an enterprise cloud computing company, announced a partnership to provide BMC’s IT management solutions on the Force.com platform.

ONE IN SIX men in the United States will develop prostate cancer. It is one of the most commonly diagnosed cancers and the second- leading cause of cancer deaths .
Yet a recent survey suggests that many men at risk for prostate cancer are unaware of the leading treatment option available: robot- assisted surgery to remove the cancerous prostate.
The survey was conducted by Intuitive Surgical, Inc., maker of the daVinci robotic surgery system that we use at Sentara Norfolk General Hospital. A cynical reader might conclude the survey was biased in favor of daVinci, but it revealed useful data about prostate cancer awareness.
For instance, the survey among 1,000 online information seekers found that 39 percent of men would go to their primary care physician for prostate cancer concerns rather than a urologist. While your PCP is certainly your first line of defense against prostate cancer through examination and screening during your annual physical, any resulting suspicion of cancer should prompt your PCP to write a referral to a urologist. If he or she doesn’t, ask.
The survey also found, alarmingly, that 34 percent of men would begin researching treatment options only after they started showing symptoms of prostate cancer. These include blood in the urine or semen or difficulty urinating, though urinary issues are more often a sign of an enlarged prostate called benign prostatic hyperplasia, or BPH.
If you do begin showing symptoms of prostate cancer, it often means it has already spread, or metastasized, beyond the prostate gland and it may be too late to achieve the “cure” offered by early detection and a robot-assisted prostatectomy while you are still symptom-free.
As men with family histories of prostate cancer are screened at earlier ages, and sometimes diagnosed, quality-of-life issues after a prostatectomy become increasingly important. These include incontinence and erectile dysfunction .
Current research, published in medical literature and the news, questions whether robot-assisted surgery offers better long-term quality-of-life outcomes than traditional open surgery.
While the jury is still out on that question, there is no doubt that men who have minimally invasive, robot-assisted prostatectomies enjoy faster recovery times, fewer transfusions because of minimal blood loss and less pain than men having traditional open surgery. The post-surgery quality-of-life questions remain the subject of ongoing research .
One aspect of prostate cancer in favor of survivability is the fact that it grows very slowly .
The best way to approach prostate cancer is with information, long before you think you need it, and early detection. This includes testing through digital rectal examination and a prostate- specific antigen, or PSA, test of your blood during your annual physical.

Clyde Ellison Snow
1912 ~ 2009
Our dear father, grandfather, great grandfather, and friend passed away November 19, 2009 at the age of 97. He was born April 24, 1912 in Provo Utah to James Spencer Snow and Edna V. Quigley. He married Donna Fern Spencer on June 12, 1935. They enjoyed 73 years of marriage together until Donna’s passing last February. Their marriage was solemnized in the Salt Lake Temple June 11, 1952.
Clyde had a deep rich baritone voice and enjoyed singing and shared his talent often at church, in plays, and at social functions. He loved all sports, hunting, fishing, and especially golf. He even started skiing again with his grandkids at age 75. Clyde loved his family and especially enjoyed playing competitive games with them.
He worked in many fields; mining in Eureka, professional painting, but excelled as a salesman working 25 years for Prudential Insurance and later for Castletons and Nordstroms.
Clyde was active in the LDS Church. He served an Eastern States Mission during the depression and another mission with his wife in the Raleigh North Carolina Mission. He also served as a Bishop, High Councilor, Temple worker, and loved to teach the Gospel Doctrine class.
Clyde is survived by his sons Don (Evelyn) Snow, Jack Snow; daughters Debbie (Craig) Ames, Lori (Howard) Layton; 12 grandchildren, Diane Linderman, Dan (Amber) Snow, Joe Snow, Portia (Dee Brewer) Snow, Tricia Snow; Cassidy (Bryan) Brooks, Christopher (Sarah) Ames, Jill Ames, Zachary Ames; Clay, Lisa, and Greg Layton; and 16 great grandchildren.
Funeral services will be held Monday November 23, 2009 at 11:00 a.m., at the Rose Park North Stake Center, 1155 North 1200 West S.L.C., UT. A viewing will be held Sunday evening from 6:00 to 8:00 p.m. at the Larkin Mortuary, 260 East South Temple, and Monday from 9:45 to 10:45 a.m. prior to the services at the church. A BUS driver who nearly lost his life in a head-on crash has won pounds 250,000 compensation.
Medics told James Morton, 60, he was lucky to survive after a Mercedes van smashed into his bus on a country road near Cramlington, Northumberland.
Mr Morton had to be cut free from the wreckage by firefighters and he was then airlifted to hospital.
His left leg was shattered below the knee and only the speed with which he was treated saved him from having to have it amputated.
Mr Morton faced further misery when his driving licence was revoked on medical grounds, forcing him to give up the job he had enjoyed for 27 years.
He was confined to a wheelchair for two years and has only recently been able to walk short distances with the aid of a stick.
Following a two-year legal battle, the van driver has admitted responsibility for the crash, which also injured several passengers.
Mr Morton, of Newbiggin, Northumberland, said: “It was mainly my leg that was injured, but it could’ve been much, much worse.
“If the van had hit another 18 inches to one side, I wouldn’t be alive to talk about it today.
“I can still remember the crash. I remember the van coming towards me and there was no way I could get out of the way.
“There were trees on the side of the road and if I’d gone either way it would’ve been worse.”
Passengers were trapped in the wreckage following the crash, which happened on Fisher Lane near The Snowy Owl pub on the A1068 at Seaton Burn, at about 8am on April 25, 2007.
At the time, police described seven passengers taken to hospital as “walking wounded”.
The driver of the Mercedes was not seriously injured. Now his insurance company has agreed to pay the compensation following a claim by Mr Morton.
He said: “I feel lucky to be alive really. You can’t put a price on an injury like that, but it’s some consolation.
“I was planning to work until I was 65, but that’s been cut short.”
The transport workers’ union Unite paid Mr Morton’s legal costs.
Davey Hall, the union’s North East regional secretary, said: “I’m pleased that the claim has been settled.
“I see it as a victory for Mr Morton and his family, and I’m very proud that the union has been able to support him throughout this ordeal.”
Kirsten Scott, of Beecham Peacock solicitors which fought to get Mr Morton’s payout, said: “This was a terrible accident for Mr Morton, but he has done incredibly well to get himself back on his feet.
“However, it is sad he will never be able to return to the job he loved.”
